General Terms and Conditions of Living-in By Romy's
Definitions
In these terms and conditions, the following definitions apply:
Additional agreement: an agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract and these goods, digital content and/or services are supplied by the entrepreneur or by a third party on the basis of an agreement between that third party and the entrepreneur;
Cooling-off period: the period within which the consumer can exercise the right of withdrawal;
Consumer: the natural person who is not acting for purposes relating to their trade, business, craft or profession;
Day: calendar day;
Digital content: data produced and delivered in digital form;
Extended duration agreement: an agreement that provides for the regular delivery of goods, services and/or digital content over a certain period;
Durable medium: any instrument – including email – that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation or use for a period appropriate to the purpose for which the information is intended, and which allows unchanged reproduction of the stored information;
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
Entrepreneur: the natural or legal person who offers products, (access to) digital content and/or services remotely to consumers;
Distance contract: an agreement concluded between the entrepreneur and the consumer within the framework of an organized system for distance selling of products, digital content and/or services, whereby exclusive or partial use is made of one or more techniques for distance communication up to and including the conclusion of the agreement;
Model withdrawal form: a digital version of the withdrawal form can be found on the website;
Technique for distance communication: means that can be used to conclude an agreement without the consumer and entrepreneur being in the same place at the same time.

Article 1 – Definitions
Living-in by Romy's: refers to Living-in by Romy's, established in (1072 VV) Amsterdam at Gerard Doustraat 72h and registered with the Chamber of Commerce under number 86266667. VAT number: NL004221580B74.
Buyer: the natural person not acting in the exercise of a profession or business who concludes an agreement with Living-in via the webshop at www.ceramicsbyromy.com.
Article 2 – General
These general terms and conditions form part of all agreements concluded by Living-in and apply to all offers made by Living-in. The applicability of the Buyer’s terms and conditions is expressly excluded. If one or more provisions are invalid, the remaining provisions remain in force.
Living-in has the right to amend and/or supplement these terms and conditions. In the event of a material change, Living-in will inform the Buyer in writing at least one month before the changes take effect. Unless the Buyer objects in writing within two weeks, the Buyer is deemed to have accepted the changes.
Additional or amended agreements made after conclusion of the agreement are only binding if confirmed by Living-in.
Article 3 – Offers
All offers from Living-in, whether oral or written (including digital offers), are non-binding and valid for the period stated. If no period is stated, the offer is valid while stocks last.
The content of offers and other materials has been compiled with care. However, Living-in cannot guarantee that all information provided is correct and complete. Prices, availability and other information are subject to obvious programming and typographical errors.
Handmade products may differ from images shown in size, structure, color and finish.
Article 4 – Formation of Agreements
Agreements are concluded when the Buyer accepts the offer and meets the conditions set by Living-in.
If the Buyer accepts electronically, Living-in will confirm this electronically. Until confirmation is received, the Buyer may cancel the agreement. If confirmation is not given within five days, the offer is considered rejected unless stated otherwise.
Article 5 – Information Provided by Buyer
The Buyer must provide all necessary information for proper order processing fully and on time. The Buyer guarantees the accuracy of this information and indemnifies Living-in against third-party claims.
Article 6 – Execution and Delivery
Unless agreed otherwise, Living-in will deliver orders within 30 calendar days after conclusion of the agreement. Risk transfers to the Buyer upon delivery.
For fragile products, including ceramic letters, the Buyer must inspect the order immediately upon receipt.
Any damage must be reported within 48 hours via webshop@living-in.nl, including clear photos of the product and packaging.
If damage is not reported within this period, Living-in cannot guarantee that it will be processed.
Article 7 – Prices & Additional Costs
All prices include VAT and other government-imposed taxes, but exclude shipping costs.
Additional costs (such as shipping or payment fees) will be communicated in advance where possible.
Living-in may adjust prices before the agreement is concluded and after three months if the agreement is not yet fulfilled. Price increases due to government measures are always permitted.
All texts and prices are subject to typographical errors.
Article 8 – Payment
The Buyer must pay according to the agreed method. Payment must be made within 14 days unless otherwise agreed.
If payment is late, the Buyer is in default and owes statutory interest. Collection costs are charged according to legal regulations after a 14-day notice period.
Article 9 – Right of Withdrawal
The Buyer may cancel the agreement within 14 days without giving reasons.
The period starts the day after receiving the product.
The Buyer must return the product within 14 days after cancellation. Return costs are borne by the Buyer.
Refunds will be made within 14 days after receiving the return or proof of return.
The Buyer is liable for any reduction in value due to improper handling.
Custom-made or personalized items are excluded from the right of withdrawal.
Article 10 – Force Majeure
Living-in is not liable for delays caused by force majeure, including extreme weather, strikes, government measures, transport issues, or supplier failures.
If force majeure lasts longer than one month, the Buyer may terminate the agreement.
Article 11 – Retention of Title
Ownership remains with Living-in until full payment has been received.
Article 12 – Warranty
The Buyer must inspect goods upon receipt.
Damage to fragile items must be reported within 48 hours with photos.
Outlet and Sale items will not be repaired or replaced. Sale items cannot be exchanged.
Article 13 – Liability
Liability is limited to the order value (excluding VAT), with a maximum of €500, unless caused by intent or gross negligence.
Claims must be reported within 14 days.
Article 14 – Consequences of Buyer Default
If the Buyer defaults, all claims become immediately due. Living-in may suspend or terminate the agreement.
Article 15 – Personal Data
Living-in processes personal data carefully in accordance with applicable privacy laws. Payment data is encrypted.
Article 16 – Applicable Law
Dutch law applies to all agreements.
Article 17 – Competent Court
All disputes will be submitted to the court in Amsterdam.
Article 18 – Complaints Procedure
Complaints must be submitted within five days. Living-in will respond within five working days and seek a solution.
